Terms of Use — Fitness Options

These Terms of Use (referred to as “Terms”) govern your use of the Fitness Options mobile application (referred to as “Application”) available on the Google Play Store and Apple App Store, developed and operated by KwebaTechHub (referred to as “Service Provider”). By downloading, installing, or using the Application, you agree to be bound by these Terms.

 

1. Acceptance of Terms

By accessing or using the Application, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree to these Terms, please do not use the Application.

 

2. Description of Service

Fitness Options is a gym management platform that provides:

  • Member registration and profile management

  • Gym attendance tracking via QR code scanning and geofence-based check-in/check-out

  • Subscription and membership plan management

  • Wallet top-up and payment processing via Paystack

  • Admin and staff management tools for gym operators

  • Real-time notifications and gym activity updates

The Service Provider reserves the right to modify, suspend, or discontinue any feature of the Application at any time without prior notice.

 

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials

  • You agree to provide accurate, current, and complete information during registration

  • You must notify the Service Provider immediately at support@kwebatechhub.com if you suspect unauthorized access to your account

  • One account per user is permitted; creating multiple accounts for fraudulent purposes is strictly prohibited

  • The Service Provider reserves the right to suspend or terminate accounts found to be in violation of these Terms

 

4. Membership & Subscriptions

  • Membership plans and subscription fees are set by the gym operator using the Application

  • Payments are processed securely through Paystack and are subject to Paystack’s Terms of Service

  • Subscription fees are non-refundable unless otherwise stated by your gym operator

  • The Service Provider is not responsible for billing disputes between members and gym operators; such disputes must be resolved directly with the gym

 

5. Wallet & Payments

  • The in-app wallet allows members to top up credits for gym-related payments

  • Wallet balances are non-transferable between accounts

  • The Service Provider is not liable for losses resulting from unauthorized wallet transactions if the account owner fails to secure their login credentials

  • Refund requests for wallet top-ups must be submitted within 7 days to support@kwebatechhub.com

 

6. Location & Geofencing

  • The Application requires access to your device’s location to enable geofence-based attendance tracking

  • By using the Application, you consent to the collection and use of your location data as described in our Privacy Policy

  • Attempting to spoof, fake, or manipulate your location to bypass geofencing checks is a violation of these Terms and may result in immediate account suspension

 

7. Acceptable Use

You agree not to:

  • Use the Application for any unlawful or fraudulent purpose

  • Attempt to reverse-engineer, decompile, or tamper with the Application

  • Share your account credentials with others or allow unauthorized access

  • Upload or transmit any harmful, offensive, or malicious content

  • Interfere with or disrupt the Application’s servers or infrastructure

  • Use the Application to impersonate another member, staff, or administrator

 

8. Intellectual Property

All content within the Application, including but not limited to logos, graphics, UI design, text, and software code, is the exclusive property of KwebaTechHub and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Application without prior written consent from the Service Provider.

 

9. Termination & Account Closure

  • You may close your account at any time via Profile → Personal Information → Close Account

  • Upon account closure, your personal data will be permanently deleted from our servers within 30 days

  • The Service Provider reserves the right to terminate your account without notice if you violate these Terms

  • Termination does not entitle you to a refund of any unused subscription or wallet balance unless required by applicable law

 

10. Disclaimer of Warranties

The Application is provided “AS IS” without warranties of any kind, either express or implied. The Service Provider does not warrant that:

  • The Application will be uninterrupted, error-free, or completely secure

  • Any defects or errors will be corrected

  • The Application is free from viruses or other harmful components

 

11. Limitation of Liability

To the maximum extent permitted by applicable law, KwebaTechHub shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Application, including but not limited to loss of data, revenue, or personal injury sustained at a gym facility.

 

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

 

13. Changes to These Terms

The Service Provider reserves the right to update these Terms at any time. You will be notified of material changes via the Application or by email. Continued use of the Application after changes are posted constitutes your acceptance of the revised Terms.
